Work accidents
If you have suffered an accident at your workplace, your employer may be legally obligated to compensate you for the damage caused to your health, integrity and life project.
In Peru, legal proceedings for workplace accidents allow for claiming full compensation for damages, including:
EMERGENT DAMAGE
Comprende los gastos médicos, hospitalarios, terapias, rehabilitación y todo desembolso económico directo derivado del accidente.
LOSS OF PROFITS
Referring to the loss of income that the worker ceases to receive due to the temporary or permanent disability caused by the accident, as well as the possible future decrease in his productive capacity.
MORAL DAMAGES
It encompasses the physical and psychological impact, the suffering, the anguish and the alteration in the quality of life of the worker and his family environment.

These compensation actions are based on the employer's failure to fulfill their duty to guarantee adequate safety and health conditions at work, in accordance with Law No. 29783 and its regulations.
The employer's liability is based on the principle of strict liability: whoever carries out a business activity that generates risk must bear the harmful consequences, even in the absence of direct fault. National case law has reinforced this criterion, even recognizing the possibility of ordering the payment of punitive damages when liability is determined.
This type of process requires a solid technical strategy, adequate evidentiary structuring, and precise knowledge of legal deadlines to avoid the expiration of the right.
At Uribe Abogados, we technically evaluate each case and provide specialized legal defense aimed at obtaining fair, comprehensive, and proportional compensation for the damage caused.
